California Assembly member Ed Chau (D – Monterey Park) introduced Assembly Bill 1104, also known as “The California Political Cyberfraud Abatement Act,” which would essentially make it against the law to publish “fake news” that could potentially impact an election. “It is unlawful for a person to knowingly and willingly make, publish or circulate on an Internet Web site, or cause to be made, published, or circulated in any writing posted on an Internet Web site, a false or deceptive statement designed to influence the vote on either of the following: Any issue submitted to voters at an election. Any candidate for election to public office.”“A deceptive statement” will be in the eye of the beholder. Any politician can say anything negative published about him or her is “deceptive” in his or her opinion.
